Everyone in this forum knows that I am a complete moron: I did not even know ROW and Schedule A. So it does not make sense in paying attention to my advice. I still have the audacity to request everyone to pay more attention to the following.
No use fighting. Only the law makers can resolve this issue and they will not listen to us and pursue their own political interests.
Are we fighting over an unexistent pie? There is not even a small pie for us while we are discussing how to divide it.
Both sides have very valid points. It is perfectly fair game for everyone to present the best option for them; since I am moron I don't even know my best option. A healthy debate on the topic is insightfull specially to morons like me. Please convince me how this fight or a similar fight (vs a healthy debate) will lead us to our goal.

I would say for EB-2 India

I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.
Here's data directly from the DOL ETA website.....
3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.
If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.
The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

Does LUD on I 140 necessarily tie to 485 receipt generation? I don't think so - why would they touch the already approved I 140 case to begin processing 485? Unless I am missing something...
My I 140 has been approved in Feb 07 from TSC and 485 application was mailed to NSC on July 2nd. No LUD on 140 and no 485 receipts yet...

I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?

Our interview lasted about 45 mins, and the District Adjudication Officer (DAO)DAO asked a use so many questions like our first date of entry, last date entry, dob of our kids, employer letter, latest pay stubs, 3 most recent W2 - all for me and my spouse, ; all related to our valid status in US, Also, our expired EAD and AP(Originals) , current EAD, I-140 doc, current H1, FP notices - I guess she asked for almost all possible docs, and asked us to hand over the photo copies.
She had all our documents(starting from earliest H1 to current H1, Birth certificates, Medicals exams, ect in front of her, and looked like she double checked the docs.
Mine was RFE last November......and am not sure what's the status is....

Well said ! $20 is not a lot but if you are first time contributor, the mind set just changes after you contribute and you become part of this organisation. And that is what we want - active participation !
We have reached 40%. To reach 50% we need $6000 more. If more people can contribute, we can reach this in no time.
The core and a lot of serious members have already contributed.
There are 2 mind sets of people on this forum:
1) I have contributed $500+ , I do not need to contribute $20 more, In anycase what is my
$20 going to do?.
2) I have never contributed, but I am ashamed of making my first contribution of only $20.
(Although that is what I am comfortable doing at this time.)
Both the above mindsets are wrong because If we have 7000+ members, out of which say 1000 have already contributed, that leaves us with 6000 members. If 6000 members contribute $1 each, we are at $ 6000 - 50% met.
Now all are not going to do it.
So you see $20 is still a good amount to start.
