As a result the DOS either under- or over-estimates the number of applicants available for adjustment of status. When the date moves forward by too large a window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that???
Indian employment-based immigrants are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS.
3) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

please refer the dates before posting such useless information. very ashamed to see some donors do this kind of mistake. unnecessarily misguiding the people. for a moment i lost hope. if this time, the uscis (after all the preadjudication numbers and all) makes this kind of stupid mistake then the USCIS should be ashamed of its existence and DHS should shove its head in some uselss thing.

don't have access to the raw data. I have spoken with personnel in the Visa Office and they have been unwilling to give out precise numbers. Rather, they have used phrases like "limited numbers" and "handful of numbers" to describe the situation.
I believe these assessments to be accurate. I base this belief on the certain knowledge that the CIS has more than enough pending China and India and India E2 cases to use up the remaining quota without having to advance cutoff dates at all.
If the CIS were processing enough cases to close out the quota, there would be absolutely need for the Visa Office to advance cutoff dates. Advancing cutoff dates if the CIS were processing enough cases to use up the quota would only result in more cases being filed than could be accommodated. There would be no point in doing this and, in fact, it would be contrary to established procedure. The only possible reason for advancing cutoff dates under present circumstances would be to allow consular posts to adjudicate more cases from their inventories.
Does this mean that the CIS is not going to approve any China or India E2 cases? Of course they will? They are a big agency and they are always adjudicating some cases. There is a difference, however, between adjudicating some cases and adjudicating a large number of cases. If they were adjudicating more than a few cases, or even likely to adjudicate more than a few cases, the VO would not have advanced cutoff dates. Doing so would have been positively harmful. The fact that VO did advance priority dates is the best evidence that the CIS is not processing enough cases to exhaust the quota.
The best evidence of this will be the establishment of the cutoff dates for the October Visa Bulletin. If the cutoff dates remain where they are, then that will be evidence that there are plenty of E2 numbers available for China and India. On the other hand, if cutoff dates for China and India E2 retrogress significantly in October, that will substantiate the position that there were only a few numbers (relatively speaking) available. If the cutoff dates retrogress, as the folks at the VO assure me they will, then that is conclusive evidence of the accuracy of this conclusion.

There is no point in sending flowers knowing nothing gonna change. it is like putting flowers to us.
Everyone has a different reason for doing this. I for one do not believe, this will give us any interim benefits. But Iam here for the long haul (2-5 years). I know that if we need to fix the system (get visa cap raised), we have to start somewhere. This will, hopefully get some conversations started in the media/congress. Who knows, this along with other initiatives that IV is undertaking/undertaken along with industry support, we might get it done in a few years.
If not, atleast I would go to bed thinking I tried...

I read on Rajiv Khanna's blog that PD for LC substitution cases should be the date when I-140 is filed for substitute however, there is evidence that USCIS has wrongly assigned orginal priority date of LC filing, to substitute (I have seen this happening in one case at least, where susbstitue got priotity date of LC).

No, I didn't go out of the country for stamping, coz i was under the impression that my visa was Change of Status from L-1 to H-1. Only now, i could find from the immigration lawyer that i don't have a valid I-94. My employer was napping too, all this while.

I totally agree. The point here is that substituted labors are not completely dead. It's like a toxic waste which is still poisoning the legal immigration biosphere.
What most ppl here are asking is to rearrange the PDs of all apps in such a way that substituted labors move back in the queue. This will give the genuine labor folks a better chance.
So just chanting that labor substitution is dead for past two years will cut no ice. All, please don't muddy the water with such statements. The real issue being discussed here is to re-sort the PD, not banning labor substitutions.
Yes it was stopped in 2007. But it still has its shadow. Back in India Did you leave in area where there was shortage of water? All I said is do not call them as jealous. They have valid grievances. If they want they can fight.

as many are aware, there was a huge rush to buy and sell pre-approved labors during july-august 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable gc seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month eb3-i stood at november 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that gc process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached i-140 on these labors that are getting approved rapidly. And the subsequent i-485 petitions on these applications are depleting the visa numbers.

My AOS case is pending and I am getting married in Feb next year. I have just found out that my spouse's passport and DOB certificate only has her first name. My spouse is from Indonesia (born and citizen of Indonesia). I am planning to use that to apply in the ROW EB3 category. Does anyone know if firsrt name and no last name on passport and DOB will be a problem for obtaiing an H1B in India and later applying for her AOS when the PD becomes current. Please share your views and have a good thxgiving!

lets say IV core comes up with COST of doing X,Y, Z fixes within XX weeks.
COST is shared among wishing to donate. This becomes like a product purchase.
Current model is not time bound nor result oriented.

If you believed in being result oriented and time bound and made an investment to file your green card, when do you think the investment will pay off? Some things money can't buy, it takes tonnes and tonnes of energy to make a change. Believe in this organization and invest your time in helping this organization.
Actively participate in all action items, mobilize your community, your state chapters. Spread awareness and build a sense of cohesiveness. Consider everyone here part of a family and remember everyone who works tirelessly work for all of us, not just them. Find out if there is anyway you can help, there are so many opportunities where IV needs all of us. Stand up, get up and move..

1. documented / undocumented is a matter of immigration status..... no human can be illegal..... an activity can be illegal which makes a person undocumented...... as defined by human law...... but above human law there is another law..... which is defined by an entity more or less we all believe in..... how can a new born child.... a creation of the creator be illegal? delivery of a child is not just a matter of mother.... its a matter of another life being brought into this world..... how can that child be illegal?
2. even felons are not shackled to bed.... unless someone is danger to others..... how can a pregnant woman just about to deliver a child be danger to anyone else.....
3. i lost my wallet few days back.... anyone could lose their wallet sometime or the other ..... it happens..... and during that time we are all driving with a license..... does it mean we all must be shackled to bed when delivering a child......
4. unpaid driving fines?? big deal.... obama had unpaid tickets.... which were paid just before announcing presidential nomination.... majority of the people voted him to become the president..... but according to you..... its ok to shackle someone when delivering a child if that person had unpaid tickets..... nice....
