Your letter nor the proposed drft amendment to CSPA does not talk about the children of parents who applied their GC under employment based category and got stuck in the Labor Card approval stage for years and when labor got approved and I140 also got approved then again stuck due to Visa retrogression. We must include injustice being done to these children and should ask for retrospective amendment to CSPA to provide relief.

My Attorney has sent in more than 2 inquiries with DOL and each time we get the same boilerplate reply saying you are in queue and we are processing it. This is an automated reply as few of my friends even got the same reply with no change except case number.
Also as for as i know there is no time limit as such as 4 months to wait before contacting DOL.
When I called the attorney she try to look up the audit reply status and read that sentence containing 4 months wait time to me from the website. I do not know how far it is true but this is what she said.

USCIS has to issue EAD within 90 days (and you are within the period) or else it has to issue an interim EAD, especially so that the applicant's job is not jeopardized.

We need a new bill which supports legal
Instead of starting afresh with a new bill, it would be wise if our lobbying efforts for legal immigration adjust to the changing political winds in Washington.
How Would a Republican Congress Handle Immigration? � The Washington Independent (http://washingtonindependent.com/101609/how-would-a-republican-congress-handle-immigration)
1. Based on the report above, the new heads of judiciary committee and Immigration Sub Committee are individuals who view "border security" as the first step towards Immigration Reform. Since a majority of members on this forum are LEGAL immigrants, we need not worry about any steps taken towards border security and ICE Enforcement.
2. We could take our efforts, straight to Congressmen Smith and King and explain the challenges we face in getting LPR status.
3. Congressman Smit represents 21st Congressional District (San Antonio- Austin) area, which has a sizeable Indian population. We can approach him after the elections and discuss our issues with him. I am not aware of Rep. Kings constituency in Iowa, but he can be approached as well.
4. Having a powerful "ear" to listen to our issues and given the limited controversy (Since a majority of US, are on the oft targeted H1B) associated with our immigration needs, we might ask the Congressman himself, what the right steps should be. (New Bill or take up the visa recapture bill (introduced by Rep. Zoe Lofgren).
5. Immigration Voice works with Patton Boggs to voice our concerns with the lawmakers. Former Senator/Congressman Trent Lott works with Patton Boggs. He was the house majority leader, Republican whip and is someone who has (or had) a lot of clout within the Republican party. He was a colleague of Rep. Lamar Smith. I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,
For 2nd Case should we file by mail, providing certain reason with the application?
I personally know someone who got BPC labor approved in Eb3, then applied for Eb2 for same position , only difference was his first company was bought by another company and he applied Perm with 2nd company.

Guys,
Please give it a thought. What IV is doing right now for GC related issues would be more or less the same kind of agenda after most of the folks get GC and will be yelling at the processing times for Citizenship. I bet on it!
There is nothing wrong in thinking ahead of time and especially having the
process initiated and getting refined with the great folks we have here(ignore the ugly stupids who cannot understand the intent of this thread)
Appreciate your idea Saralayar. Keep going!

I haven't open any SR with USCIS , but some folks mention that when they open SR they get standard reply to wait for 30 days. With visa dates going back and forth, customer should open SR as early as month start so if dates remain current for atleast two month they can get some reply. If you wait till end of month and then open SR and if USCIS ask for 30 days and date retrogress , I bet you next reply will be No visa available.
Service requests should have a wait time of 3 months or 6 months.
If you make it 5 days, people will open one every 5 days and jam the system. The speed of approvals is slow because everyone is calling, opening service requests, lawyer request, Senator request etc etc every day. Visa officer may be responding to service requests everyday coming from customer service than actually opening a file and making it ready for approval.
Common sense is missing in people.

This is a great suggestion, and thinking ahead is the name of the game!
I guess after Dual CitizenShip now in operation majority people might be interested in Citizenship and why not avail those benefits US passport is welcome in 3/4 of the world, for all the people who have travelled knows how cumbersome immigration procedures are in various countries.
Anyway Phase 2 suggestion of lobbying for including the the number of years of leagally living here in the citizenship count and getting an "option" of becoming a citizen when GC is issued would be great (because most people who have applied there GCs have been here atleast 5 years :))
The Guys who already have GC should also support this idea as they will be benifited by this as well.

Someone mentioned regarding birth certificate. I have the birth certificate which was issued by Indian Consulate. Will that work or do we need the Birth certificate from Municipality office ? Do i need to get affidavit

You should call NVC and check with them the status of your application, most likely they have done all the processing for you. I doubt that they have a visa number for you, if they did they would have called you for an interview already.
We completed package 3 already last August and sent the forms together with ORIGINAL certificates to the NVC as requested. They also asked for the visa fees at that time which we also paid. So I guess we already have visa numbers ?
Our sponsor company in the US is waiting since almost 3 years for my husband to start working for him. I think we're lucky that he's willing to wait so long and didn't give up at some point during this whole process ?
