Guys,
My lawyer applied for my visa an 23rd Apr under the masters cap. I haven't received The receipt yet. I am wondering if there is anyone on the similar lines. Please reply or is it only me with one such case. I know USCIS has said that they need till 2nd June to resolve the situation. My case is with the vermont center.
I also have my OPT case pending there. It was filed in the first week of May. I have been told that it takes around 90 days for it but sometimes it also takes place early. Please advise.

Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>
Current Name on passport: <first_name_pp>
Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>
Format of the ad we placed in Indian newspaper (TOI) and local US newspaper:
I, <first_name_pp> AKA <first_name_us> FNU AKA <first_name_us> <first_name_us> d/o <dads_name> R/o <indian_address/us_address> have changed my name to <corr_first_name> <corr_last_name>.
Format of Affidavit from India (on Rs. 10 Non Judicial Stamp Paper):
AFFIDAVIT
I, <first_name_pp>, D/o <dads_name>, R/o <indian_address>, do hereby take oath and solemnly declare as under:-
1. That I have declared my name as <first_name_us> <first_name_us> earlier.

Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

Your I-140 was approved in NSC and NOT in TSC. My observation is STRICLTY for people whose I-140s have been approved in TSC but have applied their I-485 in NSC.

I came across this website last year in November. I got active in December, and contributed, and tried to get active in my state chapter.
When I come across posts that want to remove country caps, or some other measure that is going to be harmful to me, I have to stop and ask myself if I am shooting myself in the foot by supporting IV.
Its not about whats fair. Nor about what common sense is. Its about self-interest.
If we are increasing the size of the pie, then it benefits me (ROW) to be here. If we are to fight each other over crumbs, then it doesn't.
Yes...The orgnization is about increasing the total pie and the overflow to India/china happens only after the ROW needs are complete...So your interests are taken care of...

IV strikes a blow for the high skilled community!
Remember the time when members were ringing up the phones of Senators and Congressmen during last year's CIR discussions? I suppose we all came of age around then.. and grass roots members got the idea they could make a difference.. From then on, IV has been going from strength to strength, a snowball finally on the move.. leading to the flower campaign, then the rally, and now, this!!
My hats off to the core members, who have skilfully steered this sometimes raucous, but always enthusiastic ship.
I was going through my Paypal transactions, and totting up my contributions. The tally? not nearly enough!! So adding some more to the kitty.
Its a small price to pay for the biggest payback, of all: A voice!

Thanks for all the responses and suggestion. All your suggestions mean one thing my filling the H1 this year is near to impossible. well i understand the situatiuon and now i'm in a state to plan my moves.
Firstly can i take my OPT back and continue my current masters?? I sent the forms on say 1st of April..
Sencond, Is this an option that i file my H1 with some firm next year (2008) and after my opt expires join for a Masters/PHD course get a F1 status so that i can stay in the US, then when my H1 comes to act on Oct 2008 can i take that and withdraw from the Masters program and also change from F1 to H1??? Vldrao is not a god. His assumptions are based on the facts from USCIS data, Do you know that 22k visas were not issued. If yes,quote that. Nobody knows and all are playing guessing game. Leave him alone.

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US and came back to my home town. Have been working here for 6 years now as in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

Great discussions!! we are all going in different directions... How many Labor petitions few handful? There might be ppl who are stuck legitimately and ppl who did it , it was legal. Rather we should concentrate on Retrogression of VISA numbers. Then what after July 07 , think also about 140's there were pending there are a handful with earlier priority dates. Also many times USCIS issued GC's for ppl with earlier PD's should they return their GC back ? And potato eater has mentioned its not point to argument. I dont think there are those who are blocking the system. It is sheer number of VISA's that are driving nuts. There were also proposals that VISA numbers be applied only to principal applicants. Actions like these will have impact on final numbers.
And above all this idea is not new , It was even discussed by many members (in ~2006) when Substitution was abolished. But we are already here. We will campaign like Rajiv Khanna had said and then what discuss new proposal ? I feel its not that easy to do a change for existing ones in pipeline and USCIS has completely abolished this idea altogether.
Main action agenda: Legislation to get back unused numbers. I dont want IV to waste energy or resources anything beyond this and we shouldnt keep on discussions of new proposals. Our only point of discussion should be How to get legislative fix done.
Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.
