As I read the thread above on the perennial point of contention PD or RD or ND.
My question to the forum is how can TSC (My case was filed at TSC) sent an RFE if the case is not opened....I received an RFE in Nov of 2008...my 485 RD was July 23rd 2007 and ND was Sept 5 th 2007.
The RFE was responded to....now I was surely out of the ND window last year and technically an IO shouldn't have opened my file...but apparently he did...
Since I was contacting my local congressman and Senators...I got this feedback that my case is pre-adjudicated but waiting to have a visa number available....but I don't know who to trust...I am just not very hopeful and if 485 ND is the date they go by I have no chance and will miss this opportunity too.

Just created one more poster.
One of the persons should be Director USCIS.
One letter/poster to each service center.
One I think should be President of US.
Another place could be CNN, FOX news etc.
Another one could be Congressmen

Thanks man. My decision was mainly based on the waiting period. Within 4-5 years I can get ultimate post based on my experiance at india but here I have to be in same role.
Also I am trying to start my own IT training firm there so with gods on my side in 4-5 years that company can grow to a mid size firm.

First and foremost, a Big THANK YOU to all the IV core team who along side their full time jobs were working behind the scenes in getting this done and having to go through the hecklers and naysayers.
A big thank you to Congresswoman Zoe Lofgren in helping pass all the pain and outrage of legal immigrants to the people incharge and making them listen.
Also last but not the least, every active member of IV who participated in the flower campaign, in San Jose rally and in actively informing media on IV projects to showcase legal immigration issues. And for keeping saner heads in the insane times.
BUT WE ARE FAR FROM ACCOMPLISHING WHAT WE SET OUT TO DO.

Now, instead of getting her into trouble you have to get yourself out of trouble first.
Find a cool way to send her out.
You will be in trouble anytime in future if she proves that you have employed her illegally in the past.
Going a bit tough here, sorry for that.
1. You both are in H1B (assuming you must know laws behind H1B)
2. Able to find someone inexpensive who can take care of your valuable baby
3. Powerful knowledge in technology to setup a secret camera to capture what she does the whole day
4. Collect all evidences and planning to penalize her
But you are not aware of the simple fact that it is illegal to hire and pay someone without notifying appropriate government agencies.
Anytime in future, if she is caught(chances are more as she is clearly not aware of the laws here and how serious is beating a child, if not in your place some other place), expect query from INS/IRS. This is a different country.

Guys, by all means this discussion is itself is like find no mans land.
I think we should unite among ourselves rather than talking about all these circumstances. Yes I agree with Ganguteli... People got their labor subsituted because they had a oppurtunity and a provision that was legally correct. Instead of sitting and cribbing lets look in a direction which is going to unite all these streams into a big force.
Com'on guys, stop looking at things from a closed prespective. We need to be open and look at a grand agenda.
