#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him
#10 June 2004 - Wife and I have irreconcilable differences and I separate, later file for divorce

Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

Your PD is not current this month, how come they approved it?
I am confused now!:D
I thought that with the Sept 2009 bulletin ( PD shifted to 01 Jan 2005 for EB2 India), my PD is current!

Good idea and will atleast take us some where.
Good one, Change to workflow should not be an issue, but we should have IV core support and reasonable to pool of money (not peanuts) to make this a success. I would recommend to run a funding drive, specially for this effort once IV core endorses this effort. In day to day life, Everything begins with $, you get what you pay for and nothing is free.

Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.
So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?
What do you guys think.

Denatured, looks like no one knows the exact answer. It's only the 2nd year we've had the lottery, and last year it was unexpected so not many people had 2 applications in.
If both of your H1s are approved, then I'd imagine you'd receive two approval notices with different company names on it. I believe you'd then have to choose which one you want to use for your visa stamp, and let the other company know you have to turn down their offer. I imagine they won't be happy about it, but it's your right and if you want to be ethical you can offer to refund their H1B filing fees.
I'm not an expert but from what I know the H1B is always issued for a specific person and a specific company. You are able to change the company on that visa, but the company cannot take the visa that was issued to your name and give it to another employee.
