Come to think of it, Sec. Rice said it was a case of miscommunication between the 2 agencies. Could it be that USCIS actually wanted them to make these dates current in August and DOS jumped the gun, and lot of people got screwed.

With Limited visa numbers and now USCIS has improve efficiency they will process more and mroe Eb2 ROW and Eb1 application and less spill over to Eb2 India / China.
May be Eb2 india and China will clear 6 months in a given year.

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.

Hello everyone,
Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :
1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?
2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.
3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.
Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

Hi,
we sent our passport to Houston CGI in March. We received a mail from Postoffice saying that we missed the Passport and asking us to pick up at the post office. since we were out of station, we missed it in the bulk of mails and by the time we reached, the passport was sent back.
CGI houston replied us asking to confirm if the passport returned to Houston, and on confirmation, we asked them how to proceed to get it back. We got a call the other day to my home where in the person from CGI Houston informed that the passport was sent back as the photos were not clear, and they again got it back.
Now, the passport is with them. Will going in person make the work easy? We are in Dallas, and thinking of this.

I had a friend who tried to register but the website wouldn't because he has yet to file his LC, can someone confirm this? otherwise I will personally help my friend if he is making any mistake.

What your friend can do is enter the tentative month he thinks his LC is going to be filed. He can always update his user profile once the LC is actually filed. I would however request all members who are introducing others to request them to enter a valid email that they access frequently. IV is not in the business of selling emails or sending junk mail. But valid and regularly accessed emails are a vital tool in getting members involved when a significant push is needed.

Never had any RFE. Centre - Texas.
I am expecting 2004 EB will be cleared this month. All the 2004 guys just relax and be easy ( particularly SOP ). Honestly i didnt care much before, there are million things better than gc in life. Having said that, its good to have purely for travelling purposes.
If anyone whose PD is earlier than mine, i truly apologize. Its not me, its USCIS. I have seen PDs same as mine getting approved 2 yr ago.
Stay tight and believe in yourself NOT USCIS.

House Speaker Dennis Hastert is backing away from statements made earlier this week suggesting a plan to hold hearings on the Senate�s version of the immigration reform bill.
According to Congressional Quarterly, Hastert says he'll look at that issue, but the first priority is spreading the leadership's message about the Iraq war. Hastert has said he wants to take a long look at the Senate's legislation before naming House conferees.
There are some big differences the conference committee will have to reconcile. The Senate's bill provides a pathway to citizenship for millions of illegal immigrants already in the country, and includes a guest-worker program. Neither is included in the House version, which focuses on tightening border security.

When did u mail ur application?
The slowness in the approval rate has me a little worried. In July many people got approved at within the first few days - that does not seem to have happened for the first 3 days of August so far. I'm hoping that this is just a blip and the trend picks up shortly.

I guess next time you can ask "Will I hear from you in 60 days?", then you might know if you are closer.
Perhaps we all can use that line to kind of* figure out how close we are lol :D , provided that our PD is current that is.

It is explicitly mentioned that quota is over for "year".
I always thought that DOS issues the visas to USCIS and that this is done quarterly. If this is the case, how can USCIS say that all visas are used up for this fiscal year when we are only in the 3rd quarter? Would they not be obligated to wait for new visa numbers in the 4th quarter? How can USCIS allocate more visas than they actually have. This is strange!
