PD 2001..got labor certfied online on June28 2007
I have been waiting for the hard copy..so my Hr called Dol and asked whether they have mailed. The Dol officer sent the Cover letter by email (first page of whole approved package) to company HR showing the certification . She also told HR that cover letter was enough for I140 filing.
Is it true? Please let me know.

This is printed in the I-140 instructions(page 3):
General Evidence.
Labor certification. Petitions for certain classifications must be filed with a certification from the U.S. Department of Labor.
Copies.
If these instructions state that a copy of a document may be filed with this petition and you choose to send us the original, we may keep that original for our records. Copies may be submitted of all documentation with the exception of the Labor Certification which must be submitted in the original.

its common belief that you need to work for 6 months.
There is no immediate problem if you don't but looks bad on citizenship time.

my new company filed h1 transfer on premium on 17 of jan and got fedex delivery on 18th .I have to join this company asap..so I have few question
1. can i join this company even the receipt is not available?
2. how long its take to get the receipt and approval in premium processing?
3. is there any chance to denied if yes what are those factors if any one come accross?

Hi,
I recently received EAD and my I-140 approved an year ago . I am waiting for the 180 days count down to be over. but my question here is after 180 days if i want to use AC21 , do we really need to have the I-140 apporval copy or receipt number bcz it is still with my employer and they are not going to share with the me for sure. But it got approved and year ago for me.
Also is there any way i can get the receipt number of I140 by calling the USCIS ?
Please help!

Hi all,
My wife has MSc in Comp and has work experience of 2 yrs as a programmer in India. She came last year on F2 and applied for H1 this year but She didn't get selected in the lottery. Someone told her that she can apply for jobs in universities and they do H1 (no cap).
Can someone tell us that this is true? and also suggest us where else can she try looking for jobs? Are all the Not-for-Profit organizations same in terms of doing H1 (no cap)?
I appreciate any suggestions and thanks in advance.

it is fine to have both I-485s filed and pending - generally speaking, if one gets approved, USCIS should deny the other (as a LPR you will no longer be eligible to adjust your status to lpr).

amindarshana: (1) keep checking whether you check cashed or not (2) if 45 days passed from your SR open date - you will have to reconstruct your entire 485 packet and include delivery proof, and a copy of the check that you had sent. - check with your attorney.

My Father is applying for Citizenship in Nov 10. If he becomes Citizen then can I file I485 under F3(married sons and daughters of citizen parents). Category and port priority date of May 03 from my employment base I-485 to I-485 under F3?

Unfortunately INA (immigration and naturalization act) does not allow to transfer Employment Based priority dates to Family Based immigration. So no, you can not do it.
