I filled the DS160 and took an appointment at US consulate yesterday night with out the photograph. Looks like we can submit the photograph along with the confirmation letter on the day of interview.
I thought we needed to upload the photograph for completing DS160 but that does not seem to be the case. Did any of you experience this?

Alright, I changed the font. It's kinda hard to find a nice calligraphy style font for numbers. If anyone knows of a good one, lemme know, cuz I couldn't find one.

They said she can start as soon as it it approved.Only thng i am worried about is when she wants to transfer H1b what are the hurdles have to be faced.I heard or enquired that as long as Quota is there she can transfer H1B.
Is it legally difficult because transfering from Non Profit to Regular Organization.

Hi
My husband does not have an H1 stamp in his passport even though he has been in status since he did not go to india,right now he has got 3 yr extension on the basis of an approved I-140 petition,we are going to india to get our visa stamped next month.
Can anyone advise me whether not having a previous H1 stamp in the passport will create any problems for us in getting stamped now.He was on an L1 visa before converting to H1,he has not gone to india since 2002.

I am currently in the same situation like you are (and hopefully were?); they are a mistake in filling the ETA9089.
The error is in such a way that from USCIS point of view, I worked during the gap of period between my OPT and H1-B transition.
So I guess I just want to know how your case is resolved? That way I have an idea what will happen to mine. ;(

Many of the Windows Live apps (Writer, Messenger, etc.), Windows Server Add-Ins/Components, Expression, and a handful that I can't remember use .NET either exclusively or just for the UI.

I need some advice.
I have a PD of November 9th 2001 (EB3).
My 140 and 485 was filed on August 2003.
My 140 was approved in Feb 2004.
I am now retrogressed with the November Visa bulletin showing an April 22nd 2001 PD for EB3.
As we can all see EB3 is move very very slowly and probably will continue this way (I hope I am wrong), while EB2 is already current for my PD.
From my information and some threads on this forum. I believe I have the option of filing for an EB2, while maintaining my current PD.
My Questions:
1. Does it make sense for me to refile in EB2, given my situation? PD Nov 2001 in EB3.
2. Can I apply for EB2 through the same company. (my current company)?
3. What is the process of doing so (EB3 to EB2)? Would I have to refile for labor, 140 and 485, or is their a way I could directly file for I485, since my I140 is approved and I am in the same company.
4. Would the EB2 case be a new case altogether, i.e. not related to my existing EB3 case again providing the fact that I have NOT changed employers?
5. Would I be able to use the experience I have gathered in my current job (5.5 years) in the EB2 conversion.
I will appreciate your help.

Do you know anybody that applied for extension based on medical grounds. So far I applied for extension 5 times during last 8 years for my mother-in-law and my brother-in-law and my father-in-law but all based on tourism/visiting grounds. I got extension all 5 times. Now that my mother-in-law wants to go back to india, but she just had a surgery and still in hospital and she needs to go to india next week. So we need to apply for extension.

The VBs normally come out on Fridays. So this month's VB will probably be on DOS's website this Friday. But I don't see any positive sign for EB movements. We will be lucky if EB2 and EB3 don't retrogress again, according to DOS's hint last month. To be realistic, there won't be any significant movement without any bills favoring immigration passed.

Here is my opinion:
I understand that your wife has now two I 94s: One when she entered on H4 (we will call it OLD) and one when she returned from Mexico with F1 visa stamp (we will call it NEW). And both are attached to her passport.
First of all, I dont think this is a major deal. You can do one of the two things:
1. First option is to go to near by international airport and meet CBP officer. Explain him the situation (show him the copy of air ticket to mexico and appointment letter with the consulate); chances are, he will take care of the old I 94 (but make sure to keep a copy for yourself for future reference). And you can forget about the whole thing (just keep copies of old I 94, air ticket, appt letter for future reference if any question arises at any time).
2. Second option is to nothing about this and just keep the old I94, a copy of it, copies of air ticket and appoinntment letter for your file and close the file until and unless you are asked about it. Chances are, they would have automatically changed the information in their system and you may never be asked about this old I 94. If they do, you can tell them the truth what happened. I dont think it is a major deal.
I would personally go with option 1 if the nearby international airport is not too far.
In either case, make sure of one thing: Whenever your wife leaves, she must surrender the new I 94 and not the old one. Best way is, take the old I 94 out of the passport so no confusion arises.

Hi All,
I am here in US on a H1B and my wife is on a H4. She recently got admission to a graduate school and has to start next week. I am worried that if I get her COS for the next semester (this is a 1 year program), then woud she be eligible to get her OPT at the end of the program? She would have been on a F1 for less than a year, but would have completed the Master's program.
I tried to get more information, but what I saw was that the OPT eligiblility requirement is atleast 1 full academic year on F1. Is this correct?
Help is greatly appreciated.
I am in the similar boat, don't worry your wife can always take etc classes as electives, and complete her one year. You can always pick etc classes, and make sure you remain in legal F1 visa status.
