I can't tell you how p***d I was when I read someone suggesting ppl to "enjoy the moment". For someone who has been waiting 3-4 years for labor to clear and sees ppl getting in front of the line to get the EAD/AP, its just insane. And to tell that person to be not a "spoilsport" is just rubbing salt in their wounds!
To my friends who are still stuck in PBEC, please have faith. You will hopefully be able to file 485 even after Sept when the dates retrogress again. My gut feeling is that dates will retrogress back to 2004 again. 2005 is when PERM started and that's where the bulk of applicants will come from right now. PERM filers will get the advantage of AC21 that you didn't have for all these years but plight of ppl stuck in BEC's has never been on anyone's agenda. So not much you can do.

Only difference is, you'd have "filed" 485 and if lucky you'd have gotten a receipt, because you might as well kiss your AP & EAD goodbye because there is no way they can process this ton load of apps any time soon.
I hope USCIS finally sees the injustice that has be meted out to the all the folks - whether in BEC or not - and process the application in a FIFO basis.

There are thousands of anecdotes that I could share. My best is the look of shock on one of the IV member's face when I asked him to escort one of the lawmakers who attended the Monday evening reception dinner. We couldn't believe that we see him on C-Span and he is standing next to us and supporting our cause.
- Can you imagine the feeling when a lawmakers says I know about you guys. You are doing a good job. This shows we are visible in the Hill.
- I felt great when I saw the confidence on the smiling faces of IV members when they came out of lawmakers meetings. For those who missed this historic opportunity, I can't even begin to explain the change in mindset from the initial apprehension about visiting a lawmaker's office to, "Why do I only have three meetings set up, I want to fill in for others IV members who might not have shown up due to various reasons"
For those demanding immediate results when they themselves might not have showed up at the rally the answer is, we will get our green cards eventually. There is absolutely no doubt about that in my mind but these experiences and memories will be cherished for a long time. This is also important to me. This new "experience capital" which was initially present among just the core members has trickled down to other members, we are growing in strength and reach our goal soon.
I am glad I went for three days. I wish I could stay longer.

So are we ready to create a group of 20-30 people who will schedule appts with their lawmakers and discuss overall IV provisions along with support for this specific bill?? Hundreds of such bills are introduced every year in Congress (this specific bill has been introduced several times in the past)..so we need to truly understand whether there is any appetite for lawmakers to vote for it..instead of re-assuring ourselves that this bill will somehow help us.
My lawmaker appt is on Feb 3rd. We need a structured approach with a proper group whose members follow up with each other and keep updates from lawmaker meetings. Not random posts on this thread, once in a while, that "I sent spam mails to all my senators..(mails that they will never read)". Lawmakers receive hundreds of emails everyday.
we need to create a grassroots rapport with lawmakers.
Every member who is discussing this thread and thinks this bill has a chance, schedule a meetign with your lawmaker today so that you can discuss OVERALL IV provisions and get a specific response on whether they will support, co-sponsor and vote for this bill. That will give us a direct answer instead of us speculating on the thread for months together.
If we get 40-50 lawmaker meetings scheduled over the next 3-5 weeks, that itself will provide us with enough feedback to decide whether this bill is worth it or not.
The point I am trying to make is that IV core is here to guide us and support us with national level advocacy. Nothing is going to happen in Congress until the grass roots efforts pushes congressmen/congresswomen/senators to think about a bill. Us sitting here and requesting IV to take up a cause (without any grassroots effort to back it up) is NOT going to help.
Its only after meeting a lawmaker that we realize how Congress works. No one is waiting to fight our cause...we have to push for it and use the IV platform.
So the plan can be -
1) everyone here who is positive about this bill..schedule a lawmaker meeting. I volunteer to coordinate the list of lawmaker meetings scheduled.
2) create a googlegroup with list of people working on the initiative. Keep track of feedback from each meeting.
3) WIth the feedback from the 40-50 meetings, we will know if this bill has any steam. Even if not, we will at least have established a rapport with local lawmaker offices which can be used for other piecemeal legislations that come up.
4) Keep the list of lawmaker meeting volunteers open and growing so that we will eventually have a large group of grass-roots volunteers regularly working on lawmaker meetings. These folks can keep track of legislations (through the forum, coordinator) and immediately schedule grass-roots advocacy/meetings when needed.
We have to create a culture and a habit within the EB community of regularly meeting with lawmakers so that every one of our local lawmaker offices has our issues on their fingertips (even if they oppose us). merely coming to a forum and requesting iv core to do all they can, the day before a bill is to come to vote, is (for lack of other terms) plain stupid.

Hundreds of members visit this website every day. I am just really surprised that we are having trouble getting people to participate in Advocacy Days and raising $50,000. It seems like a no-brainer to me to participate in whatever way possible.
There have been around 250 contributions so far. Some members have contributed a few hundred dollars each, with a couple of members contributing $500+ each, and some have pledged $100 for every $2500 or $5000 raised, just to help try and reach the target. They wouldn't have had to put in so much if everyone else chipped in.
I am really curious to know why you are not getting more involved and at least contributing financially to this effort if you cannot attend the Advocacy days. You are the beneficiary. What is holding you back from trying to do something tangible to help yourself, your family and your friends? Are you seriously going to tell me that it's not even worth $50 to you?
This is the best shot we are going to have in the next two years.

We have confirmed with a knowledgeable official in the Department of State Visa Office that USCIS was requesting visa numbers on Sunday July 1st, and Monday morning July 2nd - and that visa numbers were still being issued as late as the morning of July 2nd!
In fact, close to 30,000 visa numbers were requested and issued in July - through the morning of July 2nd. And we believe that many - if not most - of the requests made in the first two days of July were for applicants whose priority dates were not current in June!
So how can USCIS refuse to accept I-485 filings received BEFORE the State Department issued its notice that all visa numbers had been used???? We have not yet confirmed the return of any I-485s filed in July. But we do know that applications were reaching the USCIS before the State Department announcement - and while the USCIS was frantically working to use up the entire year's allocation.

Guys who come here on H1Bs and apply? Let us set aside the fraud inherent in L1 visa for another day. The visa recapture is there, but it is also a separate issue which takes a while to accomplish.
H1Bs can't get EB1C. They need to be outside country in 1 out of 3 prceeding years. EB1C is intracompany transfer visa. Even if one is on H1B, they will be need to moved to L1A before they attempt this to my knowledge. Again we are not here to fix the world., we are here to fight for our cause and get going.. Lets be clear.. Most guys after getting their Citizenship, will also vote for republicans... So to me if we can somehow through, under, around get that visa recapture, we are all back to business my friend.. It is not a separate issue. It is the issue..

let me take a guess - at the minimum - 2 years for your PD and 4-5 years for my PD.
I am quite confused. My date is June 2002 first week .
Not sure if it makes sense to Port to Eb2 , but big uknown is how long it would take PD to move up to June 2002.

I agree totally!! I understand the need for IV not to lobby for just one community EB2 or
EB3...but the fact is that all we see is movement in EB2 and no to very little movement in EB3....the most retrogessed and most in need community is EB3...
For new people like us, how do we get motivated for donation and all these things when we see rest of the people who are doign this still waiting for months to see some light at the end of the tunnel??
I think what would help is an action plan by IV stating what they would be doing in weeks or months to come....
may be do a campaign like a flower campaign or something to really get the attention if not this beginning of next year, when we think that CIR may be moving....
I think we are lacking an action plan here....and may be thats what we need for new people to get motivated towards....
Well Pappu, the fact of the matter is nothing has been done specifically to help EB3-I/C/ROW. IV may be EB agnostic but EB3-I seems to have been stuck forever to the point of despair.
I and other EB3s have donated to most of the IV causes and campaigns. We have written to our Senators, reps, sponsors and co-sponsors of bills but nothing has helped.
If IV renews its focus to help EB3-I/C/ROW then you can expect more contributiuons from EB3s.
I do not want a lesson on EB3/EB2/EB1...there is no end to opinions on this forum. What I and other EB3-I/C/ROW want are results. Contributions, meeting the lawmakers, writing to politicians etc will kick in fourth gear if there is a reasonable advancement of dates for EB3-I/C/ROW.
BTW, your and other IV leaders' efforts are very much appreciated. All that I am saying is that IV should be focused on EB3-I/C/ROW (through tagging recapture to a bill or something) now that EB2 is getting help from USCIS spillover.
EB3...but the fact is that all we see is movement in EB2 and no to very little movement in EB3....the most retrogessed and most in need community is EB3...
For new people like us, how do we get motivated for donation and all these things when we see rest of the people who are doign this still waiting for months to see some light at the end of the tunnel??
I think what would help is an action plan by IV stating what they would be doing in weeks or months to come....
may be do a campaign like a flower campaign or something to really get the attention if not this beginning of next year, when we think that CIR may be moving....
I think we are lacking an action plan here....and may be thats what we need for new people to get motivated towards....
Well Pappu, the fact of the matter is nothing has been done specifically to help EB3-I/C/ROW. IV may be EB agnostic but EB3-I seems to have been stuck forever to the point of despair.
I and other EB3s have donated to most of the IV causes and campaigns. We have written to our Senators, reps, sponsors and co-sponsors of bills but nothing has helped.
If IV renews its focus to help EB3-I/C/ROW then you can expect more contributiuons from EB3s.

screw you oscarzumaran. The very fact that you are so knowledgeable about fake degrees and fake experience tells me that you have good experience doing such things. And whether I port or not is none of your f**** business. I am sure your posts are being watched by IV admins and its only a matter of time you will be thrown where you always belong - DIRTY GUTTER..
eb3retro, no need to get nasty here. We all know that you probably have fake degrees and fake experience that you used to get to the US. Being in EB3 for so long without porting to EB2 proves it. You are worried you will get caught in case you port...aren't you? We get it. I have seen the pathetic English you write. And do you work for an uncle who is keeping your status alive? Surprised how I found out?
